SkyPhone Social Terms of Service
Effective date: May 12, 2026
Last revised: September 18, 2026 (Article 4-3 added, setting out the call button provided through the SkyPhone integration)
These Terms of Service (the "Terms") set forth the conditions for use of SkyPhone Social (the "Service") provided by NOMUDE Inc. (the "Company"). All users of the Service are deemed to have agreed to these Terms.
Article 1 (Scope of Application)
These Terms apply to all relationships between users and the Company concerning use of the Service. Separate individual terms and guidelines established by the Company (such as the Privacy Policy and Community Guidelines) form part of these Terms.
Article 2 (Registration)
- Use of the Service requires account registration by the method prescribed by the Company.
- Registration is limited to individuals aged 13 or older . Persons under 13 years of age may not register.
- Users under 18 years of age may be restricted from using certain features of the Service (such as the Local Resident badge and direct messages).
- Please enter true and accurate information when registering.
- Creating multiple accounts by the same person is, as a rule, prohibited.
Article 3 (Responsibility for Account Management)
- Users shall manage their account information (such as email address and password) at their own responsibility.
- Transferring, lending, or sharing your account with any third party is prohibited.
- If unauthorized use of an account is discovered, the Company may suspend the account without prior notice.
Article 4 (Handling of Posted Content)
- The copyright in text, images, videos (including the audio contained in videos), and comments posted by a user to the Service (the "Posted Content") belongs to the user.
- The user grants the Company the right to use the Posted Content to the extent necessary to provide, operate, and improve the Service , on a royalty-free, non-exclusive basis (including reproduction, display, translation, distribution, format conversion, and thumbnail generation).
- For videos, the license in the preceding item includes re-encoding for distribution (conversion of image quality and format), generation of files for segmented distribution, automatic generation of thumbnail images, and distribution from servers managed by the Company or by contractors engaged by the Company.
- The Company may convert Posted Content into other languages via the automatic translation feature and display it to other users.
- Where the Company uses Posted Content for purposes other than providing the Service, such as advertising, promotion, or sales promotion , it will obtain the poster's individual consent in advance.
- This license terminates with respect to the relevant content when the user deletes the Posted Content. However, this does not apply to secondary distributions created where other users reposted or quoted the content before deletion, or to copies retained by the Company pursuant to statutory retention obligations.
- Where a third party raises a claim regarding Posted Content, the user shall, as a rule, handle the matter themselves.
Article 4-2 (Posting of Videos)
- Videos are distributed from servers and a delivery network managed by the Company. Videos published on the video site (video.skyphone.social) can be viewed by anyone, regardless of whether they have registered an account or logged in.
- Only videos in which the poster themselves holds the rights, or for which the poster has obtained the necessary permission from the rights holder, may be posted. Unauthorized reposting of television programs, films, or other people's videos is prohibited.
- The poster must likewise hold the rights to, or have obtained the necessary permission for, any audio sources contained in a video (music, sound effects, sound recordings, etc.). The Company has not entered into any blanket licensing agreement with a copyright management organization. Videos containing audio sources to which the poster does not hold the rights, such as commercially released music or another person's sound recordings, may not be posted. Rights clearance, including for audio sources, shall be carried out at the poster's own responsibility.
- The Service has no mechanism for segregating adult content (zoning) and no age verification. Because videos can be viewed by anyone without age verification, posting videos or thumbnail images that contain sexual expression or excessively violent expression is prohibited, regardless of whether they are marked as being for adults (Article 5).
- The Company may hide or delete, without prior notice, any video that violates these Terms or the Community Guidelines. Deletion extends to exclusion from the public index, deletion of the distribution files (segmented distribution files and thumbnail images), and, where necessary, deletion of the original data in the poster's repository.
- For posters who repeatedly infringe rights, the Company will restrict video posting or suspend the account.
- The Company may be unable to delete copies of videos or thumbnail images that have been shared to other services (such as Bluesky).
- Reports of rights infringement, including those from persons who are not users of the Service, are accepted at the Rights Infringement Report Desk (no login required).
Article 4-3 (Call Button Provided Through the SkyPhone Integration)
- Where a user links SkyPhone (a calling app provided by QuadSystem Co., Ltd.) and makes their call availability public, the Company reads the call availability record stored in that user's account (repository) and displays a call button on their profile. Users may delete this record themselves at any time from "SkyPhone call button" on the settings screen.
- Removing the call button does not change the call availability setting on the SkyPhone side. To stop incoming calls themselves, set SkyPhone not to accept calls in the SkyPhone app.
- The Company may hide the call button and delete the call availability record held in the repository of an account managed by the Company where a malfunction or misuse is suspected, where the user's own wishes have been confirmed, or where there is a legitimate request from the linked provider. In such cases, the Company records its reason for doing so.
Article 5 (Prohibited Conduct)
In using the Service, users must not engage in any of the following acts.
- Acts that violate laws and regulations or public order and morals
- Acts related to criminal activity
- Acts that infringe the rights or interests of the Company, other users, or third parties (such as infringement of copyrights, trademark rights, portrait rights, or privacy rights)
- Defamation, harassment, discriminatory remarks, or threats against other users
- Posting sexual, violent, or discriminatory content
- Posting videos that contain video or audio material to which the poster does not hold the rights (such as unauthorized reposting of television programs, films, or other people's videos, or use of commercially released music without rights clearance)
- Spam, indiscriminate solicitation, or indiscriminate sending of messages
- Intentional dissemination of false information
- Acts that interfere with, or risk interfering with, the operation of the Service
- Unauthorized access to the Service's systems, reverse engineering, or mass access using automated tools
- Posting content intended to interfere with the translation feature's system instructions (prompt injection)
- Impersonating another person
- Attempting to obtain verification features such as the Local Resident badge by fraudulent means
- Any other act the Company deems inappropriate
Article 6 (Content Moderation)
- If the Company determines that Posted Content violates these Terms or the Community Guidelines, it may delete or hide such content without prior notice.
- The Service conducts moderation through a combination of automated filters, reports from other users, and manual review by the operators.
- A user who has been subject to action may file an objection within 14 days of the action.
Article 7 (Translation Feature)
- The Service automatically translates Posted Content using a third-party machine translation engine.
- Due to the nature of machine translation, loss of nuance or mistranslation may occur. The accuracy of translation results is not guaranteed.
- The Company assumes no responsibility for any misunderstanding or damage arising from translation.
- For details on the use of the translation feature, please refer to Article 3 of the Privacy Policy.
Article 8 (Advertising and Third-Party Services)
The Service may display advertisements or links to third-party services within the Service. Use of third-party services is governed by the terms and policies of those third parties, and the Company assumes no responsibility for them.
Article 9 (Fees)
Basic use of the Service is free. If paid features are added in the future, the Company will provide prior notice and establish separate fee provisions.
Article 10 (Modification and Suspension of the Service)
- The Company may change, add to, or discontinue the contents of the Service, whether or not prior notice is given to users.
- The Company may temporarily suspend provision of the Service due to system maintenance, failures, disasters, or other unavoidable circumstances.
- The Company assumes no responsibility for any damage arising from the modification, suspension, or discontinuation of the Service.
Article 11 (Suspension and Deletion of Accounts)
- If the Company determines that a user has violated these Terms, it may temporarily or permanently suspend the account without prior notice.
- Users may delete their own account at any time. Deletion is carried out immediately and there is no grace period. Logging back in after deletion does not restore the account, and the associated data cannot be restored either (except in the case of a shared account under the following item).
- Exception for shared accounts: where you share the same login credentials (account) with another service provided by the Company, the shared portions (your authentication credentials including your email address, your handle, your profile information such as display name, profile picture, bio and user name, your country of residence and language settings, your atproto account together with the past posts and images stored in it, the follow and like records that remain on Bluesky, and the translation cache for those posts) are retained rather than deleted, so that the data of that other service is not lost along with them. In that case you can log in again with the same email address. The same treatment (retention) applies where we were unable to confirm whether the account is shared. Data specific to this Service, such as videos and direct messages, is deleted regardless of whether the account is shared. In addition, if you use this Service with an account on an atproto server operated by someone other than the Company (an external service), or if deletion of the account on the Company's server fails, deletion is limited to what the Company is able to delete, and past posts and images remaining on that account cannot be deleted by the Company.
Article 12 (Disclaimer)
- The Company does not warrant that the Service is free from defects in fact or in law (such as safety, accuracy, usefulness, fitness for a particular purpose, or non-infringement of third-party rights).
- Except in cases of the Company's willful misconduct or gross negligence, the Company assumes no responsibility for any damage incurred by users arising from the Service.
- Where the Company bears liability for damages, the amount of compensation shall be capped at the total fees received from the relevant user (or 1,000 yen where the Service was used free of charge). However, this does not apply to damage caused by the Company's willful misconduct or gross negligence, or where the limitation of liability is rendered void by the Consumer Contract Act or other mandatory laws.
Article 13 (Amendment of the Terms)
The Company may amend these Terms at any time when it deems necessary. The amended Terms take effect when posted on the Service, and for material changes the Company will provide prior notice approximately 30 days in advance. If a user continues to use the Service after the amendment, the user is deemed to have agreed to the amended Terms.
Article 14 (Governing Law and Jurisdiction)
Japanese law shall govern these Terms and any dispute relating to the Service. Should a dispute arise between a user and the Company regarding the Service, the Tokyo District Court shall be the court of agreed exclusive jurisdiction for the first instance. However, where the user is a consumer under the Consumer Contract Act, this does not preclude filing suit in a court of jurisdiction permitted by the Consumer Contract Act or other mandatory laws.
